Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Longevo application and associated services (the “Service”), provided by Longevo Pty Ltd (“Longevo”, “we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years of age and a resident of Australia to use the Service. During the current trial phase, access is by invitation only and may be limited to selected participants.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly at hello@longevo.health if you suspect unauthorised use of your account.

Your Positive Health Outcome Score (“PHOS”) and tier classification are generated automatically from the health behaviour data you and your connected devices provide. The PHOS score is a health engagement indicator only. It is not a medical diagnosis, medical advice, or an individual clinical risk assessment, and it must not be relied on as a substitute for professional medical care.

We do not guarantee that any particular score, tier, insurance discount, or premium outcome will be available to you. Discounts are offered at the sole discretion of participating insurer partners and are subject to their own terms, eligibility criteria, and approval.

You control when, and with whom, you share your PHOS tier certificate. When you choose to share, we disclose only your PHOS tier classification and the period it covers — never your underlying health data. Your dealings with any insurer, including the terms of any policy or discount, are solely between you and that insurer.

You agree not to:

• Provide false, misleading, or fraudulent health or identity data
• Attempt to manipulate, reverse-engineer, or game the PHOS scoring algorithm
• Access another person's account or data without authorisation
• Use the Service in any way that breaches applicable laws or the rights of others
• Interfere with, disrupt, or compromise the security or integrity of the Service

The Service provides general wellbeing and behaviour information and is not a medical device or a provider of medical services. Always consult a qualified healthcare professional before making changes to your diet, exercise, medication, or health regimen. If you think you may have a medical emergency, call 000 or seek immediate medical attention.

The Service, including its software, design, content, and the PHOS methodology, is owned by Longevo and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use. You retain ownership of the personal data you provide.

The Service integrates with third-party providers such as wearable devices, My Health Record, and cloud and analytics platforms. We are not responsible for the availability, accuracy, or practices of these third parties, and your use of them may be subject to their own terms.

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

To the extent permitted by law, Longevo is not liable for any indirect, incidental, or consequential loss, or for any loss arising from your reliance on the PHOS score or from decisions made by insurers. Where our liability cannot be excluded but can be limited, it is limited to re-supplying the Service or the cost of re-supplying it.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, or if we discontinue the Service. On termination, the provisions that by their nature should survive — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
